Welcome to the website of Merten Land Clearing & Excavation (“Merten,” “we,” “our,” or “us”). These Terms and Conditions explain the rules for using our website and requesting information, estimates, quotes, or services from us.

By using this website, contacting us, requesting a quote, or scheduling services, you agree to these Terms and Conditions.

1. About Our Services

Merten Land Clearing & Excavation provides land clearing, forestry mulching, excavation, grading, drainage, site preparation, demolition, pond excavation, retaining wall work, driveway work, and related land services for residential, agricultural, and light commercial properties.

Our service area includes Greater Cincinnati, Loveland, Mason, Indian Hill, Milford, Anderson Township, Clermont County, Hamilton County, Warren County, Butler County, Northern Kentucky, Southeast Indiana, and surrounding areas.

Service availability may depend on project location, site access, weather, equipment availability, terrain, soil conditions, permitting requirements, and project scope.

2. Website Information

The content on this website is provided for general informational purposes only. We make reasonable efforts to keep the information accurate and up to date, but we do not guarantee that all information is complete, current, or error-free.

Images, project descriptions, before-and-after examples, service descriptions, and estimated timelines shown on this website are examples only. Every property and project is different.

3. Quote Requests and Estimates

You may request a quote through our website, phone, email, chat, or other communication channels.

When requesting a quote, you agree to provide accurate and complete information, including your name, contact details, property address, project details, site photos, access information, and any known issues that may affect the project.

Any estimate or quote we provide is based on the information available at the time. Final pricing may change if:

  • The project scope changes
  • Site conditions are different from what was described
  • Access is limited or restricted
  • Hidden obstacles, utilities, debris, rock, drainage problems, or soil issues are discovered
  • Permits, additional labor, materials, hauling, disposal, or equipment are required
  • Weather or site conditions delay or affect the work
  • The customer requests additional services

A project is not scheduled or confirmed until both parties agree to the scope, price, timeline, and any required deposit or payment terms.

4. Customer Responsibilities

Customers are responsible for:

  • Providing accurate property and project information
  • Confirming property ownership or permission to authorize work
  • Marking or disclosing known property boundaries
  • Disclosing known underground utilities, private lines, septic systems, wells, irrigation, drainage systems, fences, structures, or other site features
  • Securing any required permissions from property owners, HOAs, neighbors, landlords, municipalities, or other parties
  • Removing personal property, vehicles, animals, and obstacles from the work area
  • Providing reasonable site access for equipment and crew
  • Reviewing and approving the project scope before work begins

We may pause, reschedule, or decline work if the property is unsafe, inaccessible, misrepresented, or not ready for service.

5. Permits, Utilities, and Site Conditions

Some projects may require permits, inspections, approvals, utility markings, drainage review, or other compliance steps. Unless otherwise stated in writing, the customer is responsible for obtaining required permits, approvals, and utility location services.

We may assist with guidance, but we are not responsible for delays, fines, or issues caused by missing permits, inaccurate property information, unmarked utilities, or undisclosed site conditions.

Customers should contact the appropriate utility marking service before excavation or digging work when required.

6. Scheduling and Weather Delays

Scheduling depends on crew availability, equipment availability, weather, site conditions, and project complexity.

Land clearing, excavation, grading, and drainage work may be affected by rain, snow, freezing temperatures, saturated soil, unsafe terrain, or other conditions outside our control.

We may reschedule work if conditions are unsafe, unsuitable, or likely to damage the property or equipment. We are not responsible for delays caused by weather, site conditions, permitting, utility marking, customer delays, equipment issues, or events outside our control.

7. Payments and Deposits

Payment terms will be provided in the estimate, quote, invoice, or written project agreement.

Depending on the project, we may require a deposit before scheduling or beginning work. Final payment is due according to the agreed payment terms.

Late payments may result in delayed work, collection activity, or additional charges where permitted by law and stated in the project agreement.

All pricing is subject to the agreed written scope. Additional work, changes, hauling, disposal, materials, equipment, or labor may result in additional charges.

8. Changes to Scope

Any changes requested after approval may affect the project price and timeline.

Changes may include additional clearing, extra hauling, drainage work, grading revisions, retaining wall changes, driveway work, demolition, concrete removal, pond work, or other added services.

We may require written approval before completing additional work or making major changes to the original scope.

9. Cancellations and Rescheduling

If you need to cancel or reschedule, please contact us as soon as possible.

Cancellation terms may depend on the project size, notice provided, deposit paid, materials ordered, equipment reserved, subcontractors scheduled, and work already performed.

Deposits may be non-refundable if costs have already been incurred, equipment has been reserved, materials have been ordered, or work has begun. Any cancellation or refund terms should be stated in the written quote, invoice, or project agreement.

Certain consumer contracts may provide cancellation rights under applicable law. Where required, we will follow applicable cancellation rules.

10. Project Photos and Videos

We may take photos or videos before, during, and after a project for documentation, quality control, internal records, portfolio use, website content, social media, advertising, or customer updates.

We will not intentionally publish private contact information or sensitive personal details. If you do not want project photos or videos used for marketing, please notify us in writing.

11. Reviews and Testimonials

Reviews and testimonials shown on this website may reflect individual customer experiences. Results may vary depending on project size, property conditions, access, weather, soil, drainage, and other factors.

We may display customer reviews submitted through Google, our website, social media, or direct communication, where permitted.

12. No Guarantee of Specific Results

We work to provide professional service and clear communication, but we cannot guarantee identical results across all properties.

Land clearing, excavation, grading, and drainage outcomes may vary based on:

  • Soil type

  • Access limitations
  • Existing erosion
  • Nearby structures
